1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the WerkJob website and platform located at werkjob.com (the "Platform"), operated by Aqqount Investment and Consulting Sole Co., Ltd ("Company", "we", "us", or "our"), a company registered in the Lao People's Democratic Republic. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
2. Who We Are
WerkJob is an online job board that connects job seekers ("Candidates") with employers and recruiters ("Employers") in Laos and the surrounding region. The Platform allows Candidates to search and apply for jobs, and allows Employers to post vacancies and search for candidates. Separate commercial terms governing job postings, paid packages, and recruitment services are set out in our Terms & Conditions.
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or use the Platform. By using the Platform, you represent that you have the legal capacity to enter into a binding agreement with us.
4. Your Account
To access certain features, you must register for an account as a Candidate or an Employer. You agree to:
- Provide accurate, current, and complete information during registration;
- Keep your login credentials confidential and not share your account with others;
- Notify us immediately of any unauthorized use of your account;
- Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that contain false information or that are used in violation of these Terms.
5. Acceptable Use
When using the Platform, you agree not to:
- Post false, misleading, or fraudulent information, including fake job listings or fake candidate profiles;
- Upload content that is unlawful, defamatory, obscene, discriminatory, or infringes the rights of any third party;
- Use the Platform to collect personal data of other users for purposes unrelated to legitimate recruitment;
- Attempt to gain unauthorized access to any part of the Platform, its systems, or other users' accounts;
- Use automated tools (bots, scrapers, or crawlers) to access or extract data from the Platform without our prior written consent;
- Introduce viruses, malware, or any other harmful code;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
6. Content You Submit
You retain ownership of the content you submit to the Platform, including your résumé, profile information, company descriptions, and job listings ("User Content"). By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content on the Platform for the purpose of operating and promoting our recruitment services. You are solely responsible for the accuracy and legality of the User Content you submit.
7. Job Listings and Third-Party Content
Job listings on the Platform are created and submitted by Employers. The Company does not guarantee the accuracy, completeness, or legitimacy of any job listing, and we are not a party to any employment relationship formed between a Candidate and an Employer. Candidates are encouraged to exercise their own judgment and due diligence before applying to a listing or accepting an offer of employment. We are not responsible for the conduct, whether online or offline, of any Employer or Candidate.
8. Intellectual Property
The Platform, including its design, logos, text, graphics, and underlying software, is owned by or licensed to the Company and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.
9. Suspension and Termination
We may suspend or terminate your access to the Platform, at our discretion and without prior notice, if we believe you have violated these Terms, provided false information, or engaged in conduct that we consider harmful to the Platform, other users, or the Company. You may close your account at any time by contacting us using the details below.
10. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, the Company makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Platform, and disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that use of the Platform will result in a job offer, hire, or any particular outcome.
11. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or opportunity, arising out of or in connection with your use of the Platform, whether based on contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or applicable law. The updated Terms will be posted on this page with a revised effective date. Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Lao People's Democratic Republic. Any dispute arising from or relating to these Terms or your use of the Platform shall first be addressed through good-faith negotiation, and if unresolved, shall be subject to the exclusive jurisdiction of the competent courts of Vientiane Capital, Lao P.D.R.
